1. Acceptance of Terms

By accessing or using Professional Drafter ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Service Description

Professional Drafter is AI-assisted drafting software that turns dictation, notes and source documents into structured reports. It is used by inspectors, investigators, consultants, evaluators and other professionals who write reports as part of their work. The Service includes:

• Audio transcription capabilities
• Report generation tools
• Template-based documentation
• Multi-language support
• Cloud storage for documents

The Service is a drafting aid. It does not replace your professional judgment, and every report remains yours to review, correct and sign.

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3.3 Account Restrictions

You may not use another person's account without permission. You may not create multiple accounts for the same individual or entity unless expressly permitted.

3.4 Subscription and Billing

Certain features require a paid subscription. By subscribing, you agree to pay all applicable fees. All fees are non-refundable except as required by law. We reserve the right to change pricing at any time with notice.

4. Privacy and Security

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We implement encrypted security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure.

5. Permitted Use

You may use the Service only for:

• Creating documentation for lawful purposes only
• Managing documentation in compliance with all applicable laws (compliance is user's responsibility)
• Accessing features as intended by the Service design
• Other lawful purposes consistent with these Terms

6. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to store or transmit infringing, libelous, or otherwise unlawful material
• Interfere with or disrupt the Service or servers
• Use automated systems or software to extract data from the Service
• Resell or redistribute the Service without authorization
• Use the Service to generate false or misleading documentation

7. Intellectual Property

7.1 Service Content

The Service and its original content (excluding content provided by users), features, and functionality are owned by Professional Drafter and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service to you.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE SPECIFICALLY DISCLAIM ANY LIABILITY FOR ERRORS OR OMISSIONS IN ANY CONTENT GENERATED BY THE SERVICE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MONELI AUTOMATION INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Professional Drafter, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us at support@professionaldrafter.com.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of these Terms or the Service shall be brought in the courts of the Province of Ontario, and you consent to their jurisdiction.

If you use the Service from outside Canada, you do so on your own initiative and are responsible for compliance with your local laws.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
